Can a police officer get a search warrant if the probable cause to search will only happen in the future? Explain the reason for whether/not it is possible to obtain a warrant for evidence of a future crime. Limit your answer to three sentences or less
A police officer can get a search warrant for a future event and this is referred to as an anticipatory warrant. If the officer has a probable cause/future condition that he anticipates will happen, he can be granted an anticipatory warrant by a court of law. The anticipatory warrant does not have to detail the future condition/event but needs only state the location of the search and the parties to be searched, as was held in United States v Grubbs.
“Why do police departments fail?” what do we mean by failure? You might choose to come up with some good examples to evidence the arguments you use
The major reason why a department could fail is financial constraints. Most departments lack adequate financial resources to train their officers, pay wages, and even purchase necessary equipment and technology for their department. For example, a department could be short on cash and solely rely on donors or funding programs which are majorly unreliable. Most staff will choose to leave and find greener pastures leaving the department sorely understaffed thus forcing it to close.
Another reason why departments fail could be policymaking and implementation. Most departments use a top-down approach where instructions come from the highest levels without consulting the officers on the ground. For example, an order to use force when dealing with suspects could go against an officer’s personal values thus creating conflict between his work and his moral standing. A good solution would be to involve grassroots officers in decision making or consultation, to seem more pro-active and democratic and less dictatorial. This will also foster the spirit of teamwork and cooperation since everyone in the organization feels like their values are being accounted for
